Terms & Conditions for Shop Products

Overview

This website is operated by Michael Abid. Throughout the website, the terms "we", "us" and "our" refer to Michael Abid.

1. Scope

The following terms and conditions apply to all orders of Wall Art products (fine art prints, canvases, metal and acrylic glass prints) as well as of personal online coachings via our online shop.

2. Contractual partner, conclusion of contract

The purchase contract is concluded with Michael Abid.

The placement of the products in the online shop is not considered a binding offer on the part of the seller, but serves as a product and cost description that leads to the submission of a binding purchase offer by the customer. The customer can initially place products in the virtual shopping cart without obligation and correct his entries at any time via the online input mask before sending a binding offer. Only by clicking on the button that concludes the ordering process does the customer make a legally binding offer for the goods contained in the shopping cart. Immediately after sending the order, the customer will receive a confirmation by email.

3. Contract language, contract text storage

The languages available for the conclusion of the contract are: German on the German part of our website and English on the English part of our website. The contract text is not stored by us.

4. Delivery terms

4.1 Delivery terms for Wall Art products

The ordered goods are manufactured in Hannover, Germany and shipped from Hannover. We deliver within Germany and to many European countries. Free shipping is available within Germany for all materials and sizes. For the rest of Europe shipping costs are added to the stated product prices. The list of countries supplied with the corresponding shipping costs can be found on the Wall Art FAQ page. We do not deliver to packing stations (this is a Germany-specific shipping method).

The goods in the canvas, metal and acrylic glass print product categories are packed and shipped individually. This serves to optimally protect the goods for transport and finally to deliver them to you undamaged. As a result, we charge shipping costs in these product categories separately for each ordered item (free shipping is available within Germany).

The products in the fine art print category are sent out rolled, which makes it possible to send several items in the same package/delivery. Therefore, we only charge shipping costs once for any amount of products in the fine art print category within an order, regardless of the amount ordered (free shipping is available within Germany).

Additionally free local pickup is available at the workshop in Hannover, Germany at the following location:

Delivery times (including manufacturing and shipping) within Germany:

Delivery times in the rest of Europe are 1-2 business days longer.

In principle, delivery to other countries (e.g. Switzerland, England, USA) is possible, but not available via the preset selection in the online shop due to the complexity of the export/import regulations. Please contact us if you wish to ship to a country not listed in the default selection.

5. Payments

In our online shop we use the Dutch company Mollie B.V., Keizersgracht 126, 1015CW Amsterdam, Netherlands (website) as an external payment service provider. Mollie B.V. consolidates various payment methods such as credit card payments, Paypal, bank transfer, etc. and enables us to provide you with the following payment methods:

PayPal

During the payment process you will be briefly redirected to the website of our payment service provider Mollie B.V. and afterwards forwarded to the website of the online payment provider PayPal, where you can identify yourself with your PayPal access data and then confirm the payment request. You must be registered with PayPal to use this payment method. After completing the payment, you will be automatically redirected back to our website, where you will receive another confirmation that your payment has been made.

Credit card

Credit card payments are processed via our payment service provider Mollie B.V. During the payment process you will be forwarded to the Mollie B.V. website, where you can enter your credit card details. Mollie B.V. verfies the entered data and forwards the payment request to your credit card company. After you have identified yourself with your credit card company and have confirmed the payment request, you will be automatically redirected back to our website, where you will receive further confirmation of your payment.

SEPA Bank Transfer

Bank transfers are also processed via our payment service provider Mollie B.V. During the payment process you will be forwarded to the Mollie B.V. website, where you will be given Mollie B.V.'s bank details as well as a unique payment ID. You can then use this data to carry out a manual bank transfer yourself (e.g. in your online banking portal). Pay attention to adding the unique payment ID to the purpose of the transfer, which is needed to be able to assign your payment to your order. As soon as we have received your payment, we will inform you by email and start processing your order.

SOFORT Banking

Payments via the SOFORT Banking method are also processed via our payment service provider Mollie B.V. In order to be able to use SOFORT Banking, you must have an activated bank account with a PIN/TAN procedure. During the payment process you will be redirected to the Mollie B.V. website, where you can identify yourself and then confirm the request for payment. You will receive further instructions during the payment process. After completing the payment, you will be automatically redirected back to our website, where you will receive another confirmation that your payment has been made.

6. Reservation of ownership

The goods remain our property until full payment.

7. Transport damage

If goods are delivered with obvious transport damage, please report the damage to the deliverer as soon as possible and contact us immediately. The omission of a complaint or contact has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help me to be able to assert my own claims against the carrier or the transport insurance.

8. Warranties and guarantees

Unless expressly agreed otherwise, the German statutory right to liability for defects shall apply.

9. Customer service

You can reach us at any time with questions and complaints by email () or via the contact form. If you would like a personal phone call, please let us know in your message and leave a phone number so we can call you back - we will call you within 48 hours if possible (but usually much faster). The possibility of a callback is only offered for non-chargeable German phone numbers.

10. Right of withdrawal for Wall Art products

All Wall Art products are manufactured for you only after I have received your order according to your individual specifications (motif, size and material). For these individual products, a right of revocation according to § 312 German BGB (right of revocation and right of return for distance contracts) is excluded.

However, if the printing service has not started to produce your order yet, you can cancel it free of charge. In this case, all payments that we have received from you, including the delivery costs, will be refunded to you immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation. The same payment method that you used for the original transaction will be used for this repayment, unless another payment method is agreed.

11. Right of withdrawal and rescheduling for personal online coachings

You can cancel your personal coaching free of charge up to 48 hours before mutually agreed session time via email or contact form. In this case, the full cost for all unused hours will be refunded to you immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation. The same payment method that you used for the original transaction will be used for this repayment, unless another payment method is agreed. If you cancel within less than 48 hours before the agreed session time (time when your message arrives in our email inbox counts), 50 % of the unused hours cost will be withheld.

Rescheduling a session can also be done free of charge up to 48 hours before mutually agreed session time via email or contact form. Rescheduling within less than 48 hours before the agreed session time (time when your message arrives in our email inbox counts) is subject to a rebooking fee of 40 €, for which you will receive a separate invoice.

We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
